on this stituation: 2 players at river, 1st player bet , the second make a raise and the first player call showing a straight nuts. 1st player must have a penalty?

No, it's not an indisputable winning hand, only top set, flush or better dependant on the board are. A penalty is only invoked when a player had an indisputable winning hand (not an indisputable tying hand)
