Opinion about a translation of rules

In the brazilian translation of the Poker Rules, there is a statement that says if the deck is missing cards, a misdeal cannot be called if subtantial action hás occurred. Since I havent been accepted in the ADTP ( brazilian TDA ) I Will take my question to your expertise. A deck with missing cards ( like a player who kept his cards from previous hand should be allowed? Wouldnt that allow for a lot of angleshooting of a player intentionally holding onto his cards?
