Dealer's mistake

Before the flop player #1 bets 10 chips.  Everyone besides player #5 folds.  Player #5 calls.  There is no more bets after the flop or the next card.  After the river card is flipped, player #1 pushes all of his chips in.  Player number #5 waits for a long time to make a decision.  The dealer on mistake mucks all the cards together except the cards in the player's hands. The thought he heard player #5 verbally fold.  Player #1 shows his cards then tosses them in the muck.  Player #5 says that he had never folded.  What is call?  Dealer misdeal?

Both players still have their cards? Player #1 showed his cards so they are live whether in the muck or not.... the other player has his cards and all action is complete. Reconstruct the flop, turn, and river and award the pot to the best hand. This is NEVER a misdeal. Run a camera back if they can't agree on the board cards.

Steve, as per Jan's reply once substantial action has taken place a misdeal cannot be called (with the exclusion of some extreme situations).  The board would have to be re-created , this can be done by speaking to every player at the table and the dealer to re-create the board cards in the fairest way possible.
